Igualdade, Justiça Social e Interseccionalidade: Desafios do Estado Social no Século XXI.

Abstract

O presente trabalho se propõe a analisar as questões afetas aos desafios da aplicação do princípio da igualdade frente a uma sociedade pluricultural e multirracial do século XXI. O estudo engloba as multifacetadas versões da igualdade, para chegar ao seu sentido material, no qual ela se articula com a justiça, a liberdade, a dignidade da pessoa humana e a socialidade. Ademais, o trabalho aponta que no contexto atual, o direito à igualdade se relaciona com o direito à diferença, como forma de incluir e reconhecer as diversidades culturais, étnicas, raciais, etc. Após analisar os aspectos da igualdade, o trabalho adentra na análise das desigualdades sociais em suas variadas expressões, focando na análise de classe, raça e gênero. Assim, numa perspectiva multidisciplinar, o estudo conjuga conceitos de sociologia com aspectos jurídico-filosóficos que envolvem a concepção de justiça. Neste sentido, as desigualdades serão abordadas a partir da ótica da interseccionalidade das categorias sociais, demonstrando os cruzamentos e as interdependências entre elas. Além disso, o trabalho faz um exame jurídico-constitucional do papel do Estado Social no enfrentamento das desigualdades sociais. Dessa forma, o estudo parte da concepção originária do Estado Social, arquitetada no século XX, para analisar as dificuldades que esse sistema constitucional enfrenta das mudanças tecnológicas, econômicas e política do mundo globalizado do século XXI. Ao final, serão abordadas as diferentes faces que um novo Estado Social deve assumir para o efetivo cumprimento da igualdade material e da justiça social no contexto atual.

The present essay proposes to analyze the issues related to the challenges of applying the principle of equality in the face of a pluricultural and multiracial society of the 21st century. The study encompasses the multifaceted versions of equality, to reach its material meaning, in which it is articulated with justice, freedom, human dignity and sociality.. Furthermore, the work points that in the current context, the right to equality is related to the right to difference, as a way of including and recognizing cultural, ethnic, racial, etc. diversities. After analyzing the aspects of equality, the work goes into the analysis of social inequalities in their various expressions, focusing on the analysis of class, race and gender. Thus, in a multidisciplinary perspective, the study combines concepts of sociology with legal-philosophical aspects that involve the conception of justice. In this sense, inequalities will be approached from the perspective of the intersectionality of social categories, demonstrating the intersections and the interdependencies between them. In addition, the work makes a legal-constitutional examination of the role of the Welfare State in confronting social inequalities. In this way, the study starts from the original conception of the Welfare State, designed in the 20th century, to analyze the difficulties that this constitutional system faces from the technological, economical and political changes of the globalized world of the 21st century. In the end, the different faces that a new Social State must assume for the effective fulfillment of material equality and social justice in the current context will be addressed.
