O CONSTITUCIONALISMO POPULISTA COMO UM DESAFIO DA DEMOCRACIA DO SÉCULO XXI: UMA ANÁLISE DA HUNGRIA SOB O REGIME ORBÁN

Abstract

Governed by a conservative nationalist party, in 2011 Hungary replaced the 1949 constitution with the Hungarian Basic Law. However, from a constitutional process of doubtful legitimacy, a document was produced that has been much criticized, mainly in the sphere of constitutional law, due to the insertion of political-ideological elements that reflect the populist ideology of the government in leadership. It was observed considerable democratic backsliding in the sense of moving away the liberal principles of the state, which currently no longer includes itself in the roll of full democracies, but in the sphere of hybrid regimes, by virtue of being an illiberal democracy. In this sense, the work aims to approach the Hungarian populist constitutionalism and the illiberal reflexes on democracy. It is intended to strengthen the study by building a firm base for constitutional argumentation, delimiting basic concepts that circulate the theme. Subsequently, it is intended to the theoretical development of abusive constitutionalism and the influence on the populist phenomenon. At the end, it is proposed to reflect on Hungary's political situation, starting from the analysis between the populist constitutionalism and the current illiberal democracy. The investigation adopts a quantitative approach, and it is developed from the inductive method. The theme is approaching in an argumentative-expositive speech, exalting the use of bibliographical referential, technical-scientific articles, recent law and jurisprudence. It is also emphasized the use of authors mostly in English and Hungarian, which stand out for their sophisticated knowledge and authority on the subject. The result is that Hungary has always been a country of nationalistic thinking. The avalanche of cosmopolitan ideas after the end of the Cold War, together with the implementation of liberal democracy, caused a cultural reaction that was broken in the last years by the leadership of the conservative populist government. Based on this opportunity, it employed abusive methods of constitutional changes to essentially turn the country into an illiberal democracy.

Liderada por um partido nacionalista conservador, em 2011, a Hungria substituiu a constituição de 1949 pela Lei Fundamental húngara. A partir de um processo constitucional de legitimidade duvidosa, produziu-se um documento alvo de críticas, principalmente, na esfera do direito constitucional, em razão da inserção de elementos político-ideológicos que refletem a ideologia populista do governo na liderança. A partir de então, observa-se considerável retrocesso democrático no país no sentido de afastar os princípios liberais do Estado. Atualmente, a Hungria já não se inclui mais no rol das democracias plenas, mas sim na esfera dos regimes híbridos, em virtude de ser uma democracia iliberal. A investigação propõe abordar o constitucionalismo populista húngaro e os reflexos iliberais na democracia. Pretende-se fortalecer o estudo construindo uma base firme à argumentação constitucional, delimitando conceitos básicos que circulam o tema. Posteriormente, tenciona-se ao desenvolvimento teórico do constitucionalismo abusivo e a influência no fenômeno populista. Ao final, propõe-se a reflexão a respeito da situação política da Hungria, partindo da análise entre o constitucionalismo populista e a atual democracia iliberal. Adota-se a abordagem quantitativa, com ênfase no método indutivo, debatendo o tema de forma argumentativa-expositiva, exaltando a utilização de referencial bibliográfico, artigos técnico-científicos, legislação e jurisprudência recentes. Ressalta-se, também, a utilização de autores maioritariamente em língua inglesa e húngaros, os quais se destacam pelo conhecimento sofisticado e autoridade sobre o conteúdo. Chega-se ao resultado de que a Hungria sempre foi um país de pensamento nacionalista. A avalanche de ideias cosmopolitas, após o fim da Guerra Fria, junto com a implementação da democracia liberal, ocasionou uma reação cultural rompida nos últimos anos devido à liderança do governo populista conservador. Apoiado nessa oportunidade, empregou-se métodos de mudanças constitucionais abusivos para tornar o país essencialmente uma democracia iliberal.
