Propõe-se a avaliar os desdobramentos desse movimento, desde uma perspectiva teórica feminista interseccional, destacando os riscos de um regresso à lógica familista que caracterizava as práticas dos Juizados Especiais Criminais, cuja jurisdição para esses casos foi retirada pela Lei Maria da Penha (Lei 11.340/06). Além disso, apresenta uma proposta para repensar modelos de justiça em que as mulheres, concebidas como um grupo social heterogêneo, com posições sociais desiguais em razão da interseccionalidade entre gênero, classe social, raça, cor, orientação sexual e/ou deficiência, entre outros fatores sociais, possam ser ouvidas em suas necessidades e demandas específicas, em um panorama interventivo que se efetive em vários níveis de enfrentamento. This article questions the current proposal of the Brazilian Judiciary to adopt the so-called restorative justice model in cases of domestic violence. It examines the development of this movement, from a feminist and intersectional theoretical perspective, highlighting the risks of a return to the “familist” logic of judicial practices carried out by the Small Claims Criminal Courts, which had their jurisdiction to address domestic violence cases revoked with the edition of the so-called Maria da Penha Law (Law 11,340/06). In addition, it presents a proposal to rethink models of justice in which women – understood as a heterogeneous social group, with diverse needs rooted in unequal social positions based on the intersections of gender, social class, race, color, sexual orientation, and/or dis/ability among other social factors – can be heard in their specific needs and demands, from an interventional panorama that could be effective in several levels of action. |
