Abstract: A figura da vítima de crime e os direitos que a protegem na União Europeia têm, ultimamente, vindo a ser debatidos, nomeadamente a partir da Diretiva 2012/29/UE que destacou, por exemplo, a adequação dos espaços da justiça. Num estado de direito, os espaços da justiça (sobretudo os espaços dos tribunais) estão no cerne das estruturas cívicas e democráticas, símbolos dos princípios constitucionais da igualdade e do acesso ao direito e à justiça. Entre o processo, a forma e a função, os edifícios dos tribunais constituem a materialização visível do exercício da justiça. Daí a importância de se refletir sobre as suas condições físicas, a adequação aos diferentes tipos de conflitos e diligências processuais e, sobretudo, a adequação aos utentes e profissionais que aí entram todos os dias ou trabalham. Neste artigo, centramo-nos sobre os espaços da justiça existentes a partir da reflexão de Branco (2013; 2015), de Guia (2013; 2016) e de Pedroso (2011). Tomaremos como ponto de partida a investigação levada a cabo sobre o estatuto da vítima no processo penal e os espaços dos tribunais em Portugal para questionar se as recomendações apresentadas na referida Diretiva foram implementadas na Lei 130/2015, de 4 de setembro.
Victims of crime and their rights within the European Union have lately been discussed, in particular with the EU Directive 2012/29 which highlighted, for example, the adequacy of the spaces of justice. In the rule of law, the spaces of justice (particularly the spaces of the courts) are at the heart of the civic and democratic structures, symbols of the constitutional principles of equality and access to law and justice. Between procedure, form and function, the buildings of the courts constitute the visible embodiment of the administration of justice. Hence the importance of reflecting on their physical conditions, suitability to different types of procedural disputes and proceedings and, above all, the adaptation to users and professionals who come there every day or work there. In this article, we will focus on the existing spaces of justice stemming from the reflections by Branco (2013; 2015), Guia (2013; 2016) and Pedroso (2011). We will take as its starting point the research carried out on the status of victims in criminal proceedings and the spaces of the courts in Portugal to question whether the recommendations made in that Directive were implemented in Law 130/2015 of 4 September.
