dc.description.abstractO trabalho a seguir apresentado pretende analisar as causas da conflitualidade social à luz do olhar incontornável de um filósofo de excelência, Paul Ricoeur, dedicado estudioso dos fenómenos que comprometem a liberdade dos homens e sem dúvida, um humanista de corpo inteiro que não deixou nunca de pensar e contribuir aturadamente para a construção de soluções filosóficas mais eficazes e produtivas. Por outro lado, há que não esquecer igualmente o contributo das fontes não filosóficas para a estruturação do agir fenomenológico do homem, bem como a dialética que Ricoeur realizou no seio da aporia do outro. No fundo, tais considerações não só acolheram um espantoso elogio por parte da comunidade intelectual em geral, como permitiram lançar a semente de inovação rumo à constituição de sociedades mais solidárias, justas e humanas. Assim, partindo da análise da tragédia “Antígona” de Sófocles, procurou-se aprofundar a temática do mal em Ricoeur, prosseguindo depois para a tarefa da sua irradicação, quer à luz da conceção da amizade aristotélica, quer através da moral kantiana, ou ainda pela noção de justiça contratualista de John Rawls. Deste modo, e decorrente destas mesmas vias de moderação, responsabilidade e equidade, caminhou-se em seguida para o conceito de sabedoria prática, para daí extrair, com Ricoeur, a necessidade de um consenso mais alargado, como forma de dar cumprimento à resolução de conflitos e, com isso, permitir uma melhor deliberação tendo em vista o bem comum. Na verdade, é levando em consideração um juízo moral situado, que se promove, muitas vezes, em situações de confronto, o surgimento da prudência e da inevitável serenidade que deverá pautar o reconhecimento dos interesses das partes. Como refere Ricoeur é entre as tonalidades de cinzento, e não tanto entre o branco e o preto, que se recolherão as melhores escolhas para as ditas situações de angústia. Paralelamente, o autor não deixou de encontrar na figura excecional e extraordinária do perdão, o discurso de amplitude de uma justiça que procura demonstrar nas “alturas” a profundidade da culpa humana. É assim pelo transmitir de um testemunho de esperança, objetivado por sua vez na grandeza de espírito de cada homem, que a assunção da paz social poderá ser alcançada. Por fim, considerando que Paul Ricoeur não deixou de pensar numa colaboração mais estreita entre a literatura e o direito - tendo em vista uma maior humanização da justiça, quer pelo suprimento dos impedimentos logico-legais que a dogmatizam em excesso, quer por uma visão mais poética e imaginativa das soluções judiciais - entendeu-se assegurar a viii salvaguarda dos direitos do homem, com a consciência de que só por esta via, a reprodução do mal no mundo se desvanecerá diante de uma justiça humana, cada vez mais humana.por
dc.description.abstractthe following work to be presented aims to analyse the causes of social conflict in the eyes of Paul Ricoeur, a philosopher of excellence, dedicated scholar of the phenomenon that compromise the liberty of men and, without a doubt, a full humanist that never stopped thinking and patiently contributed to the construction of more effective and productive philosophical solutions. On the other hand, we cannot equally forget the contribution of the non-philosophical sources for the structuring of the phenomenological act of men, as well as the dialectic that Ricoeur carried out within the Aporia of the other. Deep down, said considerations not only welcomed a remarkable praise from the intellectual community in general, but also allowed to plant the seed of innovation towards the constitution of more sharing, fair and humane societies. Thus, starting from the analysis of the Antigone tragedy of Sophocles, we aimed to deepen the evil thematic in Ricoeur, following to the task of its eradication, in the light of the Aristotelian conception of friendship, and through the Kantian moral, or yet by the John Rawls contractarian notion of justice. Thereby, and resulting from these same paths of moderation, responsibility and equity, we went thereafter to the concept of practical wisdom, from where we extracted, with Ricoeur, the necessity of a wider consensus, in order to be able to resolve conflicts and, that way, allow a better deliberation having in mind the common good. In fact, it is taking into consideration a located moral judgement that is, many times, promoted in situations of confrontation the emergence of prudence and the unavoidable serenity that should direct the recognition of the parties’ interests. As it is referred to by Ricoeur, it is between the shades of grey, and not so between the black and white, that the best choices for said situation of anguish will be gathered. Concurrently, the author did not stop finding in the exceptional and extraordinary figure of forgiveness, the discourse of amplitude of a justice that aims to demonstrate the depths of human fault in the “heights”. It is, thus, in the transmission of a statement of hope in the greatness of each man's spirit, that the assumption of social peace might be achieved. Finally, considering that Paul Ricoeur did not stop thinking of a closer collaboration between literature and law - having in mind a bigger humanisation of justice, either through the suppression of the logical-legal impediments that dogmatize it excessively, either by a more poetic and imaginative view of the judicial solutions - it was found to ensure the preservation of the human rights, knowing that only this way, the reproduction of evil in the world will clear before a more and more human justice.por
