À partida, poderse-ia afrmar que se registou um processo de democratização das estruturas judiciárias, bem como uma melhoria efectiva das condições para um desempenho profssional independente e autónomo de quaisquer controlos que limitem o livre exercício das suas competências. Contudo, analisando o percurso das reformas judiciárias a partir de 1974, verifcamos que as transformações foram mais ao nível legislativo do que no desempenho dos tribunais.
É nosso objectivo, portanto, reflectir sobre a evolução da arquitectura judicial em Portugal, procurando perspectivar se o processo de transição democrática foi completamente terminado na área da justiça ou se, pelo contrário, ainda nos encontramos num processo de justiça em transição. Numa análise crítica, far-se-á um percurso histórico-judicial, através de 5 momentos identifcados, onde nos podemos confrontar com perplexidades, desafos e potencialidades para a consolidação de uma justiça efectivamente democrática, no contexto do Séc. XXI. The Revolution of 25 April 1974 had a strong impact on justice in Portugal. Initially, it could be said that there was evidence of a process of democratisation involving the judicial structures, together with effective improvements to conditions allowing for autonomous professional performance, independent of any controls that might restrict the free exercise of their competences. However, in analysing the course of judicial reforms since 1974, it can be seen that changes took place more on a legislative level than in terms of the performance of the courts. Our objective, therefore, is to reflect on the evolution of the judicial architecture in Portugal, seeking to determine whether the transition to democracy is complete in the feld of justice or whether, on the contrary, we are still faced with the process of justice in transition. This critical analysis involves a historical and judicial analysis of 5 designated moments in which the complexities, challenges and potential for the consolidation of an effectively democratic justice system within the context of the 21st. century may be examined. |
