Análise documentária de atos normativos jurídicos: um modelo de indexação por sentido.

Abstract

A organização do conhecimento humano impõe permanentes desafios à Ciência da Informação para buscar mais eficiência e melhor qualidade dos métodos e técnicas dedicados à representação, preservação e recuperação dos objetos produzidos por todas as demais ciências. Para a superação desses desafios os profissionais da Ciência da Informação precisam se preocupar com a modernização das ferramentas de controle e busca das informações de toda ordem. Apoiada na teoria da Análise do Discurso de Michel Pêcheux e nos fundamentos práticos-teóricos convencionais da Ciência da Informação, notadamente no campo da organização do conhecimento, representação e recuperação da informação jurídica, o estudo propõe um modelo de indexação por sentido de normas jurídicas e decretos presidenciais, ao nível Brasil. Depreendeu-se que a realização de uma leitura documentária que verifica a essência e o sentido real do objeto informacional jurídico pode contribuir para uma indexação mais eficaz baseada nas variáveis do tempo-espaço-sociedade. Inferiu-se que essas variáveis são determinantes na formação da força imaginária do sentido, preconizada por Pêcheux, para a percepção do sentido real intrínseco ao discurso. Todo objeto informacional, em especial o de natureza específica, contém essência e sentido discursivo perceptível ao nível da quarta dimensão da mensagem. Por fim, o profissional da informação deve ter especial atenção ao analisar objetos informacionais de natureza específica, em especial o objeto de natureza jurídica, de forma a privilegiar a observação e percepção dos sentidos indiretos, metafóricos, por vezes ocultos nas construções linguísticas do Direito. Espera-se com o modelo proposto contribuir para uma melhor eficiência na recuperação de objetos informacionais jurídicos, bem assim, auxiliar quem elabora, indexa e busca por informação dessa natureza a exemplo de leis, decretos e análogos.

The organization of human knowledge imposes permanent challenges to Information Science to seek more efficiency and better quality of methods and techniques dedicated to the representation, preservation and recovery of objects produced by all other sciences. To overcome these challenges, Information Science professionals need to be concerned with the modernization of control tools and the search for information of all kinds. Supported by Michel Pêcheux's theory of Discourse Analysis and conventional practical-theoretical foundations of Information Science, notably in the field of knowledge organization, representation and retrieval of legal information, the study proposes a model of sensitive indexation of norms laws and presidential decrees, at the Brazilian level. It is noteworthy that carrying out a documentary reading that verifies the essence and real meaning of the legal informational object can contribute to a more effective indexing based on time-space-society variables. It was inferred that these variables are determinant in the formation of the imaginary force of meaning, recommended by Pêcheux, for the perception of the real meaning intrinsic to the speech. Every informational object, especially the one of a specific nature, contains discursive essence and sense perceptible at the level of the fourth dimension of the message. Finally, the information professional must pay special attention when analyzing informational objects of a specific nature, in particular the object of a legal nature, in order to privilege the observation and perception of indirect, metaphorical meanings, sometimes hidden in the linguistic constructions of Law. The proposed model is expected to contribute to a better efficiency in the retrieval of legal informational objects, as well as to help those who prepare, index and search for information of this nature, such as laws, decrees and the similaries.
