Abstract: O presente relatório pretende descrever as atividades desenvolvidas, explicitando as competências adquiridas ao longo de três meses de estágio na subespecialidade de Psiquiatria Forense integrada na Unidade de Clínica Forense da Delegação do Centro do Instituto Nacional de Medicina Legal e Ciências Forenses (INMLCF), no âmbito do Mestrado em Medicina Legal e Ciências Forenses da Faculdade de Medicina da Universidade de Coimbra. Assim, constituem-se como objetivos deste estágio, a aquisição/aprimoramento das seguintes competências: a) saber compreender as necessidades do sistema legal relativas às opiniões da Psiquiatria no Direito Civil e Criminal, conhecer e aplicar a regulamentação legal corrente da prática psiquiátrica no que respeita à responsabilidade, confidencialidade, privacidade, consentimento informado, direito ao tratamento e más práticas; b) ter capacidade para diagnosticar e manejar todas as doenças mentais em indivíduos em contexto forense; c) ter capacidade para avaliar o risco e a perigosidade em contexto forense; d) ser capaz de compreender os assuntos ligados à implementação da legislação ligada aos assuntos forenses e à avaliação da incapacidade; e) ter capacidade de trabalhar em contextos multidisciplinares; f) ter experiência na avaliação e manejo de doentes considerados de alto risco de autoagressão, suicídio ou que ponham outros em risco; g) estar preparado para prestar esclarecimentos em Tribunal. Assim, a atividade pericial psiquiátrica permitiu-me contactar com uma área da Psiquiatria com especificidades consideráveis, não só no que se refere aos procedimentos de interface com o Tribunal, mas também consolidar a noção de qual o papel do psiquiatra em contexto forense e, nomeadamente, no que respeita a relação perito-observando, distinta da relação médico-doente.
This report aims to describe the activities developed, explaining the skills acquired over a three-month internship in the subspecialty of Forensic Psychiatry integrated in the Forensic Clinic Unit of the Delegation of the Center of the National Institute of Legal Medicine and Forensic Sciences (INMLCF), within the scope from the Master in Forensic Medicine and Forensic Sciences at the Faculty of Medicine of the University of Coimbra. Thus, the objectives of this internship are the acquisition/improvement of the following competencies: a) understand the needs of the legal system related to the opinions of Psychiatry in Civil and Criminal Law, knowing and applying the current legal regulation of psychiatric practice regarding liability, confidentiality, privacy, informed consent, right to treatment and bad practices; b) be able to diagnose and manage all mental illnesses in individuals in a forensic context; c) be able to assess risk and hazard in a forensic context; d) be able to understand the issues related to the implementation of legislation related to forensic matters and the assessment of disability; e) be able to work in multidisciplinary contexts; f) have experience in the assessment and management of patients considered to be at high risk of self-harm, suicide or who put others at risk; g) be prepared to provide clarifications in court. Thus, the psychiatric expert activity allowed me to contact a field of Psychiatry with considerable specificities, not only with regard to the interface procedures with the court, but also to consolidate the notion of what the psychiatrist's role is in a forensic context, namely, regarding the expert-observing relationship, distinct from the doctor-patient relationship.
