A tutela penal do direito à imagem. Em especial: o artigo 199.º, n.º2, b) do Código Penal.

Abstract

Ao longo das últimas décadas, é manifestamente visível o crescimento e a adesão aos meios de comunicação social, nomeadamente a Internet e as redes sociais.São instrumentos indispensáveis para o nosso dia-a-dia. Os meios supra mencionados têm criado continuamente impacto sobre as infindas convivências humanas, facilitando a comunicação, o acesso e a troca de dados informações. Sucede, porém, que para além das vantagens que derivam do uso da Internet e das subsequentes ferramentas sociais, as desvantagens e os perigos inerentes são incontornavelmente maiores. Desta forma, foi imprescindível adequar a lei a este fenómeno social, oferecendo mais segurança e proteção dos dados pessoais. Foi neste contexto que surge a presente obra, “A tutela penal do direito à imagem”. Esta analisa o bem jurídico, in casu, protegido pela Constituição da República Portuguesa, dissecando o seu conteúdo, essência e razão de ser. Descortina a concretização da tutela deste direito supraindividual domínio jurídico-penal, especificando-se num determinado tipo legal de crime que depende da utilização, exposição e publicação de fotografias e/ou de filmagens, através dos meios de comunicação social, contra a vontade da pessoa retratada. Over the last few decades, it is clearly visibile the growth and adherence to the social media, such as the Internet and social networks.They are indispensable tools for our daily life. The aforementioned tools have continuously created an impact on the endless human coexistence, facilitating communication, access and exchange of data and information. However, in addition to the advantages deriving from the use of the Internet and subsequent social tools, the disadvantages and dangers are unquestionably greater. In this way, it was essential to adapt the law to this social phenomenon, offering more security and protection of personal data. It is in this context that the present work appears, "The criminal protection of the right to the image". It analyzes the legal good, in casu, protected by the Portuguese Constitution, dissecting its content, essence and reason of being. It reveals the fulfillment of the protection of this individual right in the criminal-legal field, specifying in particular one legal type of crime that depends on the use, exhibition and publication of photographs and/or films, through the mass media, against the will of the person portrayed.
