Estudo de casos de imputabilidade penal por anomalia psíquica: Análise dos Arquivos do Conselho Médico-Legal de Coimbra no Séc. XX

Abstract

A presente dissertação pretende analisar o exame médico-legal no espaço técnico e formal, assim como no espaço público mais amplo. Foca-se na emergência deste dispositivo a nível regulamentar e legal, mas também a nível científico e social, pondo em evidência o poder que lhe era intrínseco e possíveis reflexões que advieram da sua implementação na comunidade científica em geral. Recorrendo a uma extensa investigação aos exames médico-legais da comarca de Coimbra no séc. XX, assim como à análise qualitativa de importante literatura e notícias portuguesas da época, foi possível obter diferentes padrões da ação deste dispositivo, os quais serão postos em evidência ao longo do trabalho. O recurso ao arquivo revelar-se-á uma interessante via de produção de conhecimento acerca de um dispositivo realizado num contexto passado.O trabalho está dividido em três capítulos, cada um correspondente aos diferentes paradigmas encontrados na análise dos exames. Várias problemáticas produzidas pelo exame serão abordadas, tais como o conflito gerado entre tribunal e Psiquiatria aquando da implementação do dispositivo médico. A teoria de Lombroso será invocada como procura do desvio, ligando a doença mental à criminalidade, mas também se relacionará com a identificação desse desvio por chamar a fotografia a prestar serviço na procura do invisível. Por último a influência da apropriação do discurso especializado, na construção do dispositivo na sociedade, será abordada, por via de notícias da época, e casos de simulação de loucura.Observa-se que a história de tal dispositivo não pode ser entendida exclusivamente à luz da Psiquiatria e do Direito, mas urge uma complexa análise interdisciplinar, que tem de ser situada no devido contexto.

The present dissertation intends to analyze the forensic exam in the technical and formal space and also in the wider public space. It focuses on the emergence of this device at regulatory and legal level, but also at a scientific and social level, highlighting the power that was intrinsic to it, and possible reflections that came from its implementation in the scientific community and in society in general. Through an extensive investigation of the forensic device in the twentieth century in Coimbra, and a qualitative study of important portuguese literature and journal news of the epoch, it was possible to obtain different patterns of the action of this device, which will be highlighted in the course of the work. The use of the archive will prove to be an interesting way of producing knowledge about a device produced in the past.The work is divided into three chapters, each corresponding to the different paradigms found in the analysis of the exams. Several issues produced by the exam will be addressed, such as the conflict generated between court and psychiatry when implementing the medical device. Lombroso's theory will be appealed as a search for deviance, linking mental illness to criminality, but it will also relate the identification of such deviance by calling photography to service, in the search for the invisible. Finally, the influence of the appropriation of specialized discourse in the construction of the medical device in society will be studied, through news of the time, and cases of simulation of madness.It was observed that the history of such a device can’t be understood exclusively in the light of psychiatry and law, but there is a need for a complex interdisciplinary analysis, which has to be placed in the proper context.
