A salvaguarda jurisdicional da eficácia horizontal e vertical dos direitos humanos e fundamentais à luz do transconstitucionalismo: paradigma, método e teoria

Abstract

A presente dissertação versa sobre a deliquescência do modelo estadual vestefaliano, marcado pela estrutura hierárquica kelseniana do direito estadualista, em razão do advento do transconstitucionalismo – um paradigma, uma teoria e um método para o Direito – e sobre a salvaguarda jurisdicional da eficácia horizontal e vertical dos direitos humanos e fundamentais nesse novo contexto. Conforme lição de Norberto Bobbio, o problema grave de nosso tempo, com relação aos direitos do homem, é o de protegê-los. Com fulcro nessa ideia é que elegemos a abordagem dos direitos humanos pelo prisma da salvaguarda jurisdicional. A partir de uma vasta pesquisa bibliográfica, realizamos um trabalho científico de jaez interdisciplinar, que transita por diferentes áreas do conhecimento, tais como a Filosofia e a Sociologia, não obstante correlacionadas à perspectiva jurídico-constitucional. Eis o problema enfrentado: faz sentido abordar, na atual conjuntura normativa multinível, a questão da proteção dos direitos humanos e fundamentais em termos de eficácia horizontal e eficácia vertical? O estudo do direito comparado, a análise doutrinária e o exame jurisprudencial demonstram a existência de manifestações transconstitucionais de tutela da eficácia dos direitos humanos e fundamentais no bojo de relações jurídicas entre particulares e de liames travados entre indivíduo e Estado, razão pela qual a referida clivagem permanece atual e relevante, enquanto via ou ferramenta teórica tendente a fornecer uma compreensão contextualizada do atual panorama global de salvaguarda desses direitos.

The present scientific article deals with the deliquescence of the westphalian state model, marked by the hierarchical structure of state law defended by Hans Kelsen, because of the advent of transconstitutionalism - a paradigm, a theory and method for Law - and the jurisdictional safeguard of horizontal and vertical effectiveness of human rights and fundamental rights in this new context. According to the lesson of Norberto Bobbio, the serious problem of our time, with respect to the rights of man, is how to protect them. At the heart of this idea is that we choose the approach of human rights through the prism of the judicial safeguard. From a vast bibliographical research, we carry out a scientific interdisciplinary work, which transits through different areas of knowledge, mainly Law, Philosophy. Here is the problem: does it make sense to address, in the current multilevel normative environment, the question of the protection of human and fundamental rights in terms of horizontal effectiveness and vertical effectiveness? The study of comparative law, doctrinal analysis and jurisprudential examination demonstrate the existence of transconstitutional manifestations of protection of the effectiveness of human rights and fundamental rights within the framework of legal relationships between private individuals and of relationships between individual and State, which is why the said cleavage remains current and relevant, as a theoretical tool or tool intended to provide a contextualized understanding of the current global picture of safeguarding these rights.
