Abstract: A segunda metade do século XX trouxe grandes avanços no Direito Internacional, em especial, na sua humanização, estabelecendo, como objetivo mundial, a proteção do indivíduo. Por outro lado, a eficácia máxima dessa proteção entra em conflito com bases fundadoras das relações entre os Estados, como a soberania e a não-ingerência. Assim, buscaram-se criar mecanismos que possibilitassem a proteção aos indivíduos, mesmo contra seu próprio Estado.
