As escutas telefónicas, são cada vez mais utilizadas como meio de obtenção de prova, é necessário perceber se os requisitos para a sua realização estão a ser respeitados, é obrigatório seguir o que esta consagrado na lei e muitas vezes não é isso que acontece. Os conhecimentos fortuitos que podem surgir durante a realização de uma escuta telefónica, também são muito importantes pois são conhecimentos de novos crimes que não se tinha conhecimento no momento da autorização da escuta telefónica.
