Violência doméstica baseada no gênero: análise das legislações brasileira e portuguesa

Abstract

A presente tese visa estudar a violência doméstica e intrafamiliar cometida em função do gênero, sendo que a mulher é vítima deste crime na maior parte dos casos, e analisar as legislações criadas no Brasil e Portugal como meio de combater tal crime que sempre ocorreu dentro dos lares, porém começou a ter maior visibilidade nos últimos anos. Para tanto, será realizada uma breve abordagem histórica e alguns conceitos importantes serão definidos, tais como gênero, violência doméstica e violência contra a mulher, bem como tratar de alguns instrumentos internacionais que impulsionaram na criação das leis protetivas em ambos os países. Também serão estudadas as leis mais importantes, citando algumas políticas públicas e órgãos especiais que cuidam da prevenção e proteção das vítimas de violência doméstica. Por fim, serão discutidas quais ações estatais foram positivas no sentido de coibir a prática do crime e será realizada uma crítica às legislações, bem como do seu âmbito de proteção e eventual proteção deficiente ou excessiva.Palavras-chave: Violência doméstica.
