Resumo: O stalking consiste numa série de comportamentos de assédio persistente de que uma pessoa é vítima por parte de outra, podendo existir/ter existido entre elas uma relação prévia ou serem desconhecidos. Estas condutas podem revestir a mais variada natureza, e, frequentemente, se vistas de forma isolada, podem parecer simples atos de cortejamento e de demonstração de afeto, sendo, dessa forma, desvalorizadas pela sociedade. Um dos primeiros países a criminalizar o stalking foi os Estados Unidos da América, mais concretamente, o Estado da Califórnia, em 1990, na sequência da morte de uma atriz norte-americana assassinada por um fã, e de outras quatro mulheres assassinadas pelos seus ex-maridos ou ex-namorados. Também vários países europeus incluíram o stalking nos seus ordenamentos jurídicos, autonomizando-o de outros crimes, nomeadamente, do crime de violência doméstica. Em Portugal estas condutas foram criminalizadas em 2015, estando plasmadas no artigo 154º-A do Código Penal, sob a epígrafe “Perseguição”. Com o presente trabalho pretendemos abordar a temática do stalking. Para isso, começaremos por tentar defini-lo, perceber quais os comportamentos suscetíveis de integrar este fenómeno, quais as principais características do ofensor e da vítima, que consequências tem nas vítimas e quais as principais estratégias por estas levadas a cabo com a intenção de superar os danos que aquelas condutas lhe provocaram. Posteriormente, faremos uma breve análise da forma como o stalking foi criminalizado noutros países, nomeadamente, nos Estados Unidos da América, na Dinamarca, na Alemanha e em Itália. Passaremos, depois, à análise do stalking no nosso ordenamento jurídico, tentando perceber quais as razões que levaram à sua criminalização e procedendo ao escrutínio do artigo 154.º-A do Código Penal. Por fim, confrontaremos a forma como o stalking era percecionado na jurisprudência portuguesa antes da criminalização, com a forma como ele é visto atualmente, visando entender se a criação deste novo crime veio, de facto, acautelar o interesse das vítimas ou se foi apenas uma neocriminalização sem grandes efeitos práticos, fruto de pressões sociais na esfera legislativa, culminando na criminalização de atos do quotidiano.
Stalking consists of a series of persistent harassment behaviors of which one person is victim of another, and there may exist or have existed between them a relationship or be unknown. These behaviors may be of the most varied nature and, frequently, if seen in an isolated form, may seem simple acts of courtship and demonstration of affection, and are not taken into account or valued by society. One of the first countries that criminalized stalking was United States of America, more specifically the State of California, in 1990, following the death of a North-American actress murdered by a fan and four other women murdered by their ex-husbands or ex-boyfriends. Several European Countries also included stalking in their legal systems, making it independent of other crimes, including the crime of domestic violence. In Portugal, these conducts were criminalized in 2015, being embodied in article 154-A of the Criminal Code, under the heading “Persecution”. With the present work, we intend to board the matter of stalking. For this, we will start to try to define and understand which behaviour is susceptible of integrating this phenomenon, what are the main characteristics of the offender and the victim, what consequences it has on the victims and what are the principal strategies taken by them with the intention of overcoming the damages that those conducts caused. Subsequently, we will make a brief analysis of the way stalking was criminalized in other countries such as United States of America, Denmark, Germany and in Italy. We will then go on to analyze the stalking in our juridical system with the purpose of understanding the reasons that led to its criminalization and proceeding to the scrutiny of article 154-A of the Criminal Code. Finally, we will confront the way stalking was perceived in Portuguese jurisprudence before the criminalization with the way it is currently seen, to understand if the creation of this new crime came, in fact, to caution the interest of the victims or if it was just a neo-criminalization without great practical effects, due to social pressure in the legislative sphere, culminating in the criminalization of everyday life.
