dc.description.abstractNesta tese de Doutoramento temos como objetivo traçar o processo histórico de cientificação de medicamentos em Portugal entre 1940 e 1990, tomando como estudo de caso a evolução técnico científica operada ao nível dos procedimentos de Autorização de Introdução no Mercado (AIM). Esta análise teve como pano de fundo as vertentes normativa e institucional pelo que acaba por fazer simultaneamente a história legislativa e regulamentar de uma parte considerável do setor do medicamento em Portugal. A tese está dividida em III partes, que coincidem com as fases da história da regulação do medicamento em Portugal. Assim, a Parte I trata a 1ª fase de regulação do medicamento em Portugal; a Parte II a 2ª fase de regulação e a Parte III o final da 2ª fase e o início da 3ª fase de regulação do medicamento em Portugal, lançando as bases a uma futura investigação. Na Parte I começamos por descrever os primórdios da regulação do medicamento industrializado em Portugal, em jeito de contextualização da criação da Comissão Reguladora dos Produtos Químicos e Farmacêuticos (CRPQF) em 1940. Começamos por descrever as primeiras tentativas de regulação e de garantia de qualidade do medicamento industrializado, via regulação do exercício profissional farmacêutico, procurando demonstrar que, à semelhança do que aconteceu noutros países, também em Portugal a motivação oficial passava pela regulação económica do setor. Ainda na Parte I descrevemos a criação da CRPQF. Começamos por falar da instituição em si, descrevendo as suas competências e atribuições no setor do medicamento, justificando deste modo a visão oficial sobre o medicamento, uma visão economicista voltada para a defesa e desenvolvimento industriais. Depois de analisarmos as primeiras medidas da instituição dentro dos contextos político, económico e técnico-científico passamos então ao ponto central da nossa investigação, ou seja, a descrição e análise dos mecanismos de avaliação de medicamentos. Terminamos esta fase analisando o crescimento económico e científico em matéria de medicamentos, procurando concluir acerca dos efeitos da criação da CRPQF e de que modo a política industrial do regime, caracterizada pelo condicionamento industrial, se refletiu na Indústria Farmacêutica nacional. A Parte II é dedicada à publicação do Decreto nº 41448 de 18 de dezembro de 1957. Procuramos desde logo demonstrar o carácter pioneiro deste diploma e concluímos, com base em dados estatísticos, acerca da sua influência no circuito nacional de avaliação de medicamentos e no mercado farmacêutico em geral. Terminamos este capítulo com o Caso Lipocina, procurando justificar a sua influência na publicação do Decreto nº 41448. Descreve-se pela primeira vez num trabalho académico detalhadamente o caso em si e o processo de tribunal, ambos exemplificativos da forma de olhar o medicamento e das bases em que assentava a regulação do medicamento em Portugal em meados do século XX. No final da Parte II falamos sobre o movimento de reorganização da Indústria Farmacêutica nacional que se começou a desenhar ainda no final dos anos 50 do século XX e que vai ditar a política económica e de saúde do medicamento nas décadas seguintes. Na Parte III analisamos os primórdios da influência da adesão de Portugal à Comunidade Económica Europeia (CEE) no que respeita à avaliação de medicamentos. Começamos por descrever a evolução do estatuto jurídico do medicamento na União Europeia (UE), pois ele é determinante para o desenrolar de acontecimentos que caracterizam o final da 2ª fase de regulação do medicamento em Portugal. Decidimos alargar a nossa cronologia para o Capítulo 5 (1965 – 2015) e analisar toda a evolução da Europa do Medicamento, desde a publicação da primeira diretiva sobre especialidades farmacêuticas em 1965 até à última reforma do sistema operada em 2004 e suas consequências. À semelhança do que foi feito para os outros capítulos, o elemento central da nossa análise e estudo passou pelos procedimentos de autorização e avaliação de medicamentos. No último Capítulo descrevemos a criação da Direção Geral de Assuntos Farmacêuticos (DGAF) como a primeira tentativa portuguesa de criação de uma agência reguladora do medicamento e analisamos as mudanças e/ou continuidades operadas no sistema de registo e avaliação de medicamentos em Portugal, quer do ponto de vista institucional, quer do ponto de vista legislativo e normativo. Este trabalho pretende preencher uma importante lacuna na História da Farmácia e da Ciência em Portugal, onde não conhecemos nenhum trabalho que trate o tema da história da avaliação e registo de medicamentos com a mesma profundidade a que nos propomos. Não se pretende neste trabalho proceder a uma análise jurídica da legislação farmacêutica existente e da sua evolução. O objetivo deste trabalho passa por descrever a evolução nacional e comunitária em matéria de regulação do medicamento, tendo como elemento central de análise a avaliação de medicamentos em Portugal e contextualizando-a do ponto de vista normativo e institucional.pt
dc.description.abstractIn this doctoral thesis, we aim to trace the historical process of medicines cientification in Portugal between 1940 and 1990, using technical and scientific development of the marketing authorisation (MA) procedures as case study. The normative and institutional framework served as background for this analysis, which simultaneously traced the legislative and regulative history of a considerable part of the medicines sector in Portugal. The thesis is composed of three parts, each exploring a specific stage in the history of drug regulation in Portugal. Part I focuses on the first stage of drug regulation in Portugal; Part II examines the second stage of drug regulation and Part III explores the end of the second stage and beginning of the third stage of drug regulation, opening avenues for future investigation. In Part I we start by describing the first steps of medicines regulation in Portugal, as context for the creation of Comissão Reguladora dos Produtos Químicos e Farmacêuticos (CRPQF - Regulatory Committee for Chemical and Pharmaceutical Products) in 1940. We start by describing the first attempts at creating regulation and ensure the quality of industrialised medicines, via the regulation of the pharmaceutical profession, in order to demonstrate that, similarly to other countries, the economic regulation of the pharmaceutical industry was also the driving force in Portugal. We continue on to describe the creation of CRPQF – the institution per se, defining its purpose and aims within the medicines sector, thus justifying the economic character of its official vision on drugs, focused on industry protection and development. Once we analyse the first institutional measures within the political, economic and scientific contexts, we move on to the core of our investigation: the description and analysis of evaluation mechanisms for drugs. We conclude by analysing the drug-related economic and scientific growth, aiming to determine the effects of the founding of CRPQF and the ways in which the industrial policy of the regime, characterised by industrial restrictions, impacted the national pharmaceutical industry. Part II focuses on the publishing of Decree no. 41448, 18th December 1957. We aim to demonstrate the pioneering character of this legislation and draw conclusions on its influence on drug evaluation and on the pharmaceutical market, using statistical data. We close this chapter with the Lipocina case, aiming to explain its influence on the publishing of the Decree no. 41448. For the first time, an academic piece describes this particular case and respective court case in detail, both of which exemplify the approach to drugs and drug regulation in the mid-20th century in Portugal. To conclude Part II, we discuss the movement of reorganisation of the national pharmaceutical industry, which started to form towards the end of the 1950’s and dictated the economic and health policy in the decades that followed. In Part III we analysed the early stages of the influence of Portugal’s accession to the European Economic Community (EEC) on drug evaluation. We start by describing the progress of the legal status of drugs in the European Union (EU), as it became a determining factor in events that characterised the end of the second stage of drug regulation in Portugal. We decided to extend our timeline in Chapter 5 (1965 – 2015) and analyse the entire development of the status of drugs in Europe, from the publishing of the first decree on pharmaceutical specialties in 1965 to the last system reform in 2004, as well as its impact. Similarly to other chapters, the focus of our analysis and studies was centered on drug approval and evaluation procedures. In the final chapter, we describe the creation of Direção Geral de Assuntos Farmacêuticos (DGAF - General Directory for Pharmaceutical Affairs), as the first attempt at creating a national regulatory authority in Portugal and analyse the changes and/or similarities operated across the drug registration and evaluation system in Portugal, from institutional, legislative and normative perspectives. This investigation aims to fill in an important gap in the history of pharmacy and science in Portugal, as we are not aware of any piece which explores the topic of drug registration and evaluation with the depth and detail we propose. We do not intent to present any legal analysis of the pharmaceutical legislation and its development; instead we aim to describe the national and European drug regulation evolution, having the evaluation of drugs in Portugal as the central analysis and contextualising it within its normative and institutional spheres.pt
