Abstract: Nos últimos anos tem sido intensa a produção teórica e empírica em torno da ligação entre feminismo e direito, emergindo os estudos feministas críticos do direito como um importante espaço de debate e reflexão que desafia o cânone mais tradicional do direito. A questão prévia, e mais ampla, consiste em saber se o direito pode ser um instrumento de promoção da igualdade e um recurso efetivo das mulheres para a garantia dos seus direitos, ou se, pelo contrário, reproduz um sistema de opressão. Neste artigo lançam-se pistas para a investigação desta última hipótese recorrendo a uma das reivindicações feministas que mais atenção tem merecido por parte do Estado e do direito nas últimas décadas: o combate à violência sobre as mulheres. A violência nas relações de intimidade permanece na atualidade como uma relevante fonte de exclusão social. Contudo, com uma crescente visibilidade na esfera pública, traduzida num claro aumento das denúncias, este tipo específico de violência tem sido objeto de diversas políticas, em particular dirigidas à sua criminalização. Baseado numa análise crítica da evolução legislativa do crime de violência doméstica em Portugal e nas entrevistas realizadas a 80 magistrados/as, este artigo procura contribuir para evidenciar algumas das críticas feministas ao direito mediante problemas que persistem no combate a este tipo específico de violência.
In recent years there has been intense theoretical and empirical debate around feminism and law, having the feminist critical theory of the law emerged as an important forum for debate and reflection that challenges its more traditional perspective. The preliminary question, and wider, is whether the law can be an instrument for promoting equality and an effective means by which women could guarantee their rights, or if, on the contrary, it is a system of oppression. In this article, some hypothesis about this question are raised, using as case-study one of the feminist demands that deserved more attention by the state and law in recent decades: the fight against violence against women.Violence in intimate relationships remains today as a major source of social exclusion. However, with increasing visibility in the public sphere, reflected in a clear upsurge of complaints, this particular type of violence has been the subject of various policies, particularly directed to its criminalization. Based on a critical analysis of the legislative evolution of the crime of domestic violence in Portugal and on interviews with 80 judges and public prosecutors, this paper seeks to contribute to highlight some important feminist critiques of the law by identifying some problems that persist in the legal fight against this particular type of violence.
