Participação de terceiros investidores nos direitos económicos do praticante desportivo : problema ou solução numa ótica juslaboral?

Abstract

Os avultados valores associados às transferências de atletas profissionais de futebol, fruto da capitalização do universo sportivus, despoletou o interesse de terceiros investidores, potenciando o nascimento de mecanismos contratuais que consentem na participação de terceiros investidores nos direitos económicos do praticante desportivo, fenómeno mundialmente conhecido, como Third Party Ownership – TPO. A falta de regulamentação e adequado enquadramento jurídico e normativo sobre a matéria, faz brotar uma série de desconfianças relativamente à admissibilidade de tal fenómeno. Centrando a investigação numa perspetiva juslaboral, analisa-se a possibilidade de conciliação de tais práticas com os direitos laborais do praticante desportivo, reclamando uma regulamentação e enquadramento jurídico idóneos, que garantam o respeito dos direitos laborais do praticante desportivo. ABSTRACT The huge values associated to transfers of football players, result of capitalization of the sportivus universe, triggered the interest of third party investors, boosting the birth of contractual mechanisms which allow the participation of third party investors in the economic rights of the athlete, a phenomenon known as Third Party Ownership – TPO. The lack of regulation and appropriate legal and regulatory framework on the subject, brings several suspicions regarding the admissibility of such a phenomenon. Focusing the research on a perspective centered on the labor law, we analyze the possibility of reconciling such practices with the labor rights of the athlete, demanding regulation and a suitable legal framework which would guarantee the fulfillment of the labor rights of the athlete
