dc.description.abstractO presente artigo desenvolve uma análise do contributo da Convenção Europeia dos Direitos Humanos (CEDH) e do Tribunal Europeu dos Direitos Humanos (TEDH) para a proteção dos direitos das crianças em conflito com a lei. Atentar-se-á, em especial, nos artigos 3.º, 5.º e 6.º da CEDH que têm sido invocados no TEDH, no âmbito de casos de crianças em conflito com a lei e respetiva jurisprudência. Embora a CEDH contenha parcas referências a crianças, alguns dos seus artigos têm sido invocados a favor da defesa e proteção destas. Para além das restrições negativas impostas aos Estados-membros, o TEDH adotou uma interpretação relativista e mais ampla dos artigos 3.º, 5.º e 6.º da CEDH e impôs obrigações positivas aos Estados-membros, em relação aos direitos das crianças em conflito com a lei, apoiando-se noutros instrumentos internacionais, como a Convenção Internacional sobre os Direitos da Criança.por
dc.description.abstractThis article analyzes the contribution of the European Convention on Human Rights (ECHR) and of the European Court of Human Rights to the protection of the rights of children in conflict with the law. More specifically, it discusses Articles 3, 5, and 6 of the ECHR and related jurisprudence of the European Court of Human Rights in cases of children in conflict with the law. Although the ECHR contains few direct references to children’s rights, the European Commission of Human Rights and the European Court of Human Rights have made considerable contributions to the promotion and protection of children’s rights. In cases of children in conflict with the law, alongside the negative restrictions imposed on member states, the European Court of Human Rights adopted a relativist and wider interpretation of Articles 3, 5 and 6 of the ECHR and imposed positive obligations to the member states, drawing namely onthe provisions of the UN Convention on the Rights of the Child (CRC).por
