Abstract: A dissertação que segue aborda a questão polêmica envolvendo o prazo de caducidade previsto para a interposição da ação de investigação da paternidade (artigo 1817.º, n.º 1, do Código Civil Português) e a sua resolução através da perspectiva do jurisprudencialismo do Mestre António Castanheira Neves. O tema mostra-se relevante por, mesmo depois de inúmeras pronunciações do Tribunal Constitucional Português, sendo o Acórdão n.º 394/2019 o pronunciamento mais recente, ser ainda objeto de recursos que visam discutir sua constitucionalidade. Em linhas iniciais, procurou-se caracterizar o jurisprudencialismo em seus traços principais, a sua específica racionalidade jurídica - composta pelos conceitos de sistema e problema -, e sua metodologia. Na sequência, procuramos expor os contornos da polêmica envolvendo o referido prazo - o surgimento na legislação portuguesa, os desdobramentos na jurisprudência e a reflexão feita por importantes doutrinadores que se debruçam sobre o tema. Ao final, faz-se um essencial recorte histórico-social dos valores comunitários (do ponto de vista do investigado e do investigante) pertinentes ao referido prazo e as suas questões adjacentes. Retomando, então, brevemente os conceitos dirimidos nos primeiros capítulos do trabalho, percorrendo o caminho traçado pela proposta jurisprudencialista em sua específica metodologia, propomos oferecer uma sugestão adequada de solução do conflito através do mecanismo de preterição desenvolvido pelo Mestre António Castanheira Neves.
The dissertation that follows addresses the controversial issue involving the expiry period provided for the filing of the paternity investigation lawsuit (article 1817.º, n. º 1, Portuguese’s Civil Code) and its resolution through the perspective of the jurisprudentialism of Master António Castanheira Neves. The topic is relevant because, even after numerous pronouncements by the Portuguese Constitutional Court, with Court's judgment n.º 394/2019 being the most recent one, is still the subject of appeals aimed at discussing its constitutionality. In initial lines, we endeavored to characterize the jurisprudentialism in its main features, its specific legal rationality - composed by the concepts of system and problem -, and its methodology. In the sequence, we seek to expose the contours of the controversy involving that term - the emergence in Portuguese legislation, the developments in jurisprudence and the reflection made by important scholars who focus on the subject. At the end, an essential historical-social cut is made of the community values ​​(from the point of view of the investigated and the investigator) relevant to the referred term and its adjacent issues. Resuming, then, briefly the concepts settled in the first chapters of the work, traversing the path traced by the jurisprudentialist proposal in its specific methodology, we propose to offer an adequate suggestion of conflict solution through the "preterição" mechanism developed by Master António Castanheira Neves.
